Terms and Conditions for Waste Collection Tooting
These Terms and Conditions set out the basis on which we provide waste collection services in Tooting and surrounding areas. By booking a collection, using our services, or allowing our team to access your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person or business placing a booking for waste collection services.
Services means the waste collection, removal, loading, transport and related services that we agree to provide.
Waste means the items, materials, rubbish, junk, garden waste, household waste, commercial waste or similar materials that you ask us to collect and remove, excluding any prohibited items as set out in these Terms and Conditions or under applicable law.
Premises means the property, site, building, land or location from which the waste is to be collected.
We, us and our refer to the business providing waste collection services trading as Waste Collection Tooting.
2. Scope of Services
We provide waste collection services for household and commercial customers in Tooting and nearby areas. Our services may include loading and removal of waste, clearing of accessible areas, and transport of waste to appropriately licensed disposal or recycling facilities.
The precise scope of the service will be agreed at the time of booking or, where applicable, on site following an assessment of the waste. We reserve the right to adjust the price if the volume, weight, access requirements or type of waste differs from the information provided at the time of booking.
3. Booking Process
3.1 You may request a booking for waste collection by telephone, email, online form, or any other method we make available.
3.2 When requesting a booking, you must provide accurate and complete information, including the type and approximate volume of waste, the location of the premises, access details, and any relevant restrictions such as parking or time limits.
3.3 We may provide an estimated price based on the information you supply. This estimate is not binding if the actual waste or site conditions differ from your description. In such cases, we will confirm the revised price before proceeding with the collection.
3.4 A booking will only be confirmed once we have accepted your request and, where required, received any applicable deposit or pre-payment. We reserve the right to decline any booking at our discretion.
3.5 For larger collections, commercial jobs or regular waste services, we may require a written service agreement or confirmation by email before commencing any work.
4. Access and Customer Responsibilities
4.1 You must ensure that we have safe, reasonable and lawful access to the premises on the agreed date and time. This includes arranging any necessary permissions, parking, keys, gate codes or entry instructions.
4.2 You are responsible for ensuring that the waste intended for collection is clearly identified, accessible, and not mixed with items that you wish to retain. We are not responsible for items mistakenly presented as waste for removal.
4.3 Where waste is located inside a building, upper floors, basements, gardens or other areas with restricted access, you must inform us in advance. Additional charges may apply for difficult access, excessive carrying distances, or unforeseen obstacles.
4.4 You must not request removal of any items that you do not have authority to dispose of. By presenting items for collection, you confirm that you are the owner of those items or have full permission from the owner or relevant authority to dispose of them.
5. Waste Types and Prohibited Items
5.1 We will collect general household and commercial waste, bulky items, garden waste, and other non-hazardous materials as agreed.
5.2 Certain items are prohibited or restricted by law or by our internal policies. These include, without limitation, asbestos, clinical or medical waste, chemicals, solvents, oils, fuels, gas bottles, explosives, radioactive materials, and any other hazardous or dangerous substances.
5.3 If you present prohibited or restricted items for collection, we may refuse to collect them, adjust our charges to cover additional handling or disposal, or terminate the service without refund. You will be responsible for any costs or liabilities arising from your failure to comply with waste regulations.
5.4 We will dispose of collected waste in accordance with applicable waste management regulations, using licensed facilities where required. We may separate materials for recycling or recovery where possible.
6. Pricing and Payment
6.1 Our charges are based on factors including the volume and weight of waste, type of waste, loading time, access conditions, and any additional services requested.
6.2 Prices may be quoted as fixed fees, volume-based bands, time and labour rates, or a combination. All prices will be communicated before work commences. If the circumstances change or new information comes to light on site, we will inform you of any price adjustments and obtain your agreement before proceeding.
6.3 Unless otherwise stated, all prices are exclusive of any applicable taxes, levies or statutory charges that may be imposed.
6.4 Payment is due on completion of the collection unless we agree alternative terms in writing. We may require full or partial upfront payment, especially for larger or commercial jobs.
6.5 We accept payment by cash, card, bank transfer or other methods that we may specify. Failure to make payment when due may result in interest charges, suspension of services, or recovery action for outstanding amounts.
7. Cancellations and Changes
7.1 You may cancel or reschedule your booking by giving us reasonable notice by telephone or email.
7.2 If you cancel more than 24 hours before the scheduled collection time, any deposit paid may be refunded at our discretion, subject to deduction of any costs already incurred.
7.3 If you cancel within 24 hours of the scheduled collection time, fail to provide access to the premises, or we are unable to complete the job due to circumstances within your control, we may charge a cancellation fee or retain all or part of any deposit to cover our costs, travel and lost time.
7.4 We may cancel or reschedule your booking due to events beyond our reasonable control, such as severe weather, traffic disruptions, vehicle breakdowns, staff illness, safety concerns, or regulatory restrictions. In such cases, we will aim to offer an alternative time or refund any payment received for the affected booking.
8. Service Delivery and Timeframes
8.1 We will use reasonable endeavours to attend your premises on the agreed date and within the estimated time window. However, any times given are estimates only and are not guaranteed.
8.2 We will not be liable for any loss, cost or inconvenience arising from delays or failure to attend at the estimated time where the cause is outside our reasonable control.
8.3 You must be present at the premises during the collection unless we have agreed alternative arrangements in advance. If you are not present, we may be unable to complete the job and may treat this as a late cancellation.
9. Liability and Limitations
9.1 We will exercise reasonable care and skill when providing our services. However, we shall not be liable for any damage to property, possessions, fixtures, fittings, driveways or grounds where such damage arises from pre-existing defects, weak or unstable surfaces, or your failure to inform us of relevant risks.
9.2 You are responsible for protecting any areas of the premises that may be vulnerable to damage, including covering floors, removing fragile items, and highlighting any known issues. We are not responsible for accidental damage to items or areas that were not reasonably foreseeable as at risk.
9.3 To the fullest extent permitted by law, we exclude all liability for loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising from or in connection with our services or these Terms and Conditions.
9.4 Our total liability to you in respect of any claim arising from a single event or series of connected events shall be limited to the total price paid or payable for the relevant services.
9.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
10. Customer Indemnity
10.1 You agree to indemnify us and hold us harmless against any claims, losses, costs or liabilities arising from:
a) your breach of these Terms and Conditions;
b) your failure to comply with waste regulations or to disclose the nature of the waste;
c) any injury or damage caused by hazardous or prohibited items within the waste; or
d) any claim by a third party that the items collected did not belong to you or were removed without appropriate authority.
11. Waste Documentation and Regulations
11.1 We operate in accordance with UK waste legislation and duty of care requirements. Where required, we may issue relevant documentation, such as waste transfer notes, describing the nature and quantity of waste collected.
11.2 You agree to provide accurate information for any waste documentation, including your name, address, business details (if applicable), and a clear description of the waste.
11.3 We reserve the right to refuse collection if we believe that proceeding would breach waste regulations or pose a risk to health, safety or the environment.
12. Complaints and Disputes
12.1 If you are dissatisfied with any aspect of our services, you should contact us as soon as possible, providing details of your concerns and any relevant evidence.
12.2 We will investigate complaints promptly and aim to resolve issues through discussion, clarification or, where appropriate, a partial refund or re-attendance. Any remedy will be offered at our discretion and in line with applicable consumer law.
12.3 If a dispute cannot be resolved directly, you may have rights to pursue the matter through alternative dispute resolution or the courts, depending on your status as a consumer or business customer.
13. Data Protection and Privacy
13.1 We collect and process personal information such as your name, contact details, address and payment information for the purposes of managing bookings, providing services, and maintaining records.
13.2 We will handle your personal data in accordance with applicable data protection laws. Your information will only be shared with third parties where necessary for service delivery, legal compliance, or as required by law.
14. Amendments to these Terms
14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise notified to you.
14.2 The version of the Terms and Conditions in force at the time of your booking will apply to that booking, unless a change is required by law or we agree otherwise with you.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of waste collection services.
